SHORT/LONG TERM RENTAL AGREEMENT ELITE HOMES COMPANY SRL
Applicable under the Legislation of the Republic of Moldova
This document represents the Terms and Conditions governing the use, lease, and occupation of apartments and associated services provided by Elite Homes Company SRL (IDNO 1024600079429, VAT 0510096), a company legally registered and operating under the legislation of the Republic of Moldova, hereinafter referred to as “Elite,” acting in the capacity of the Lessor. These Terms and Conditions constitute a legally binding agreement between Elite and the individual (hereinafter referred to as the “Lessee” or “Tenant”) who reserves or occupies the rental unit.
1. General Provisions
These Terms and Conditions apply to the reservation, leasing, occupancy, and use of residential units operated by Elite. By engaging with the services of Elite through the website, phone, third-party booking platform, or by any other method, the Lessee agrees to abide by all the provisions described herein, as well as all applicable laws and regulations of the Republic of Moldova.
2. Reservation and Accommodation Conditions
Reservations are confirmed exclusively upon full or partial prepayment, as determined by Elite and indicated during the booking process. Booking confirmation is subject to apartment availability and successful verification of the Lessee’s identification documents. The Lessee is required to provide a valid government-issued photo identification (e.g., passport or national ID) upon check-in. Elite reserves the right to decline a reservation or refuse accommodation if the Lessee fails to provide necessary documentation, or if the reservation is determined to be fraudulent or in conflict with these Terms.
Check-in is permitted from 14:00 local time on the day of arrival. Check-out must occur by 11:00 on the departure date. Late check-out or early check-in is subject to prior written approval and additional charges may apply. Failure to vacate the premises on time may result in financial penalties, removal of belongings, and/or immediate legal measures.
3. Object of Lease
The object of the lease includes the residential apartment as identified in the booking confirmation, and extends to all immovable and movable goods within the premises. This includes but is not limited to furniture, household appliances, decorative items, linens, consumables, and other amenities supplied by Elite for the Lessee’s use during the lease term. Upon check-in, the Lessee will receive a detailed inventory list to be verified and acknowledged. Elite reserves the right to deduct from the security deposit the value of any items lost or damaged during the term of the lease.
4. Lease Term
The lease term commences from the check-in date and time as agreed and terminates on the check-out date and time. In cases where the Lessee voluntarily terminates their stay before the agreed departure date, Elite is under no obligation to refund the remaining rent for unused days. Extensions to the lease period must be requested in writing and are subject to availability and confirmation from Elite.
5. Delivery of Premises and Key Access
Elite shall deliver the property in a clean, habitable condition, with all appliances in working order. The handover of the apartment is completed through a physical or digital check-in inspection, and documented by a Delivery-Acceptance Protocol. Access to the apartment is typically granted via a secure key box located at the property. The Lessee will receive a digital access code via email or text message before arrival. The Lessee agrees to maintain the confidentiality of access codes and not to share them with unauthorized individuals.
6. Return of Property and Inventory Condition
Upon termination of the lease term, the Lessee must vacate the apartment and leave all furnishings, goods, and appliances in the same condition as received, subject to normal wear and tear. A final inspection will be conducted, and the Lessee shall be liable for any damage, loss, or unusual degradation of the premises or its contents.
7. Security Deposit and Financial Guarantees
Elite reserves the right to require a security deposit at the time of reservation or check-in. The amount will be specified in the booking confirmation. This deposit serves as a guarantee against damage, theft, excessive cleaning, or breaches of the lease terms. Refund of the deposit will be processed within 7 (seven) working days after check-out, provided that no deductions are necessary.
8. Rights and Obligations of the Parties
The Lessee has the right to quiet enjoyment of the leased premises, to receive prompt assistance in resolving technical problems, and to request additional services where available. The Lessee is obligated to use the premises in a responsible manner, comply with all applicable laws, and not cause disturbance or damage to the property, neighboring units, or common spaces. Subleasing or transferring the lease to third parties is strictly forbidden without the prior written consent of Elite.
Elite reserves the right to enter the property in emergencies, for repairs, inspections, or other justified reasons, upon prior notice to the Lessee where practicable.
9. Rent Modifications
For leases exceeding one month, Elite reserves the right to adjust the rental price upon mutual agreement with the Lessee. Rent shall remain fixed for short-term leases unless otherwise stipulated in writing. Price changes for optional services or government-imposed tax changes may apply.
10. Termination and Cancellation
This contract may be terminated by Elite without prior notice in cases of serious breach by the Lessee, including but not limited to: intentional property damage, illegal activity, non-payment, or repeated complaints from neighbors. Termination will not result in any refund of paid rent.
11. Utility Payments
For stays of 30 days or less, all utilities (electricity, gas, water, internet) are included in the rental fee. For stays exceeding 30 days, utilities shall be paid separately based on consumption, to the bank account provided by Elite. Lessees will receive periodic statements detailing their consumption and payment instructions.
12. Prohibited Activities
The Lessee is strictly prohibited from organizing parties, events, photo or film shoots, seminars, workshops, or similar gatherings within the apartment. Prostitution, group sex, and any illegal activities are expressly forbidden. Smoking is not permitted indoors. The Lessee shall not cause noise disturbances or engage in any activity that disrupts the peace of the condominium.
The Lessee is strictly prohibited from engaging in any behavior that violates the purpose of the residential lease, including but not limited to:
- Hosting parties, celebrations, or gatherings of any kind, whether private or commercial.
- Organizing or permitting photo sessions, film or video recordings, live broadcasts, or use of the apartment as a recording studio or production set.
- Conducting business meetings, seminars, conferences, classes, or workshops.
- Using the apartment for any form of prostitution, sexual services, or participation in group sex.
- Smoking inside the apartment, including tobacco, cannabis, or any substances prohibited by Moldovan law.
- Possessing or using illegal substances or equipment, including narcotics, weapons, or hazardous chemicals.
- Causing excessive noise, especially during quiet, including through loud music, instruments, or shouting.
- Housing pets or animals without prior written approval from Elite.
- Tampering with fire detection systems, security cameras, locks, or other safety installations.
- Disposing of garbage improperly or neglecting hygiene standards within the property.
- Subletting the property, assigning the lease to third parties, or granting unauthorized access to the apartment.
- Engaging in any form of vandalism, theft, or damage to property.
- Allowing more guests than the maximum occupancy defined in the reservation without Elite’s prior consent.
Violation of any of the above may result in immediate termination of the lease, eviction without notice, loss of deposit, and liability for any damages incurred.
13. Notification Procedures
All notifications or communications between Elite and the Lessee shall be made in writing and transmitted via email, messaging application, or platform through which the booking was made. Notices shall be deemed received upon electronic confirmation of delivery.
14. Applicable Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the Republic of Moldova. Any dispute arising from this contract shall be resolved amicably where possible, or otherwise referred to the competent courts of Chisinau, Republic of Moldova.
15. Condominium Rules and Fire Safety
The Lessee agrees to comply with all internal condominium regulations, including noise restrictions, use of shared spaces, and disposal of waste. The Lessee undertakes not to engage in activities that pose fire hazards, such as open flame use or tampering with smoke detectors. Misuse of fire safety equipment is grounds for immediate eviction.
16. Additional Services and Guest Benefits
Elite offers additional services upon request, including airport transfers, cleaning, grocery delivery, and tourism support. Long-term guests (over 7 days) may benefit from bonuses such as free weekly cleaning, early check-in or late check-out where available, and priority booking for future stays.
17. Personal Identification Information
We may collect personal identification information from Users in a variety of ways in connection with activities, services, features or resources we make available on our website or in the context of lease agreements. Users may visit our site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, with the understanding that it may prevent them from engaging in certain site-related or service-related activities.
18. Non-Personal Identification Information
We may collect non-personal identification information about Users whenever they interact with our website or services. This information may include the browser type, computer system, operating system, and technical information about Users’ means of connection to our website or services, such as the Internet service provider or device type.
19. Web Browser Cookies
Our website may use “cookies” to enhance the User experience. Users’ web browsers place cookies on their hard drive for record-keeping purposes and, in some instances, to track information about them. Users may choose to set their web browser to refuse cookies or to alert them when cookies are being sent. Disabling cookies may result in limited functionality of some parts of the website.
20. Data Protection and Security
Elite implements appropriate data collection, storage, and processing practices, along with security measures, to protect against unauthorized access, alteration, disclosure, or destruction of your personal information, including username, password, transaction information, and data stored on our systems. Access to sensitive data is restricted to authorized personnel only.
21. Sharing of Personal Information
We do not sell, trade, or rent Users’ personal identification information to third parties. We may share generic aggregated demographic information not linked to any personal identification information with our business partners, trusted affiliates, and advertisers for the purposes outlined above.
22. Changes to the Privacy Policy
Elite reserves the right to update or modify this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this document to stay informed about how we are protecting the personal information we collect.
23. Acceptance of Terms
By using our services or visiting our website, you signify your acceptance of these Terms and our Privacy Policy. If you do not agree, please refrain from using the website or renting a property. Continued use of our services following updates to these Terms will be deemed acceptance of those changes.
24. Legal Disclaimer and Limitation of Liability
Elite Homes Company SRL shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the leased premises or services provided, including but not limited to damages for loss of profits, data, or other intangibles. Elite is not responsible for delays or failure to perform any part of the agreement due to events beyond its control, including but not limited to natural disasters, acts of God, governmental restrictions, or failures of third-party service providers (e.g., internet, utilities).
Lessee accepts full responsibility for the security of their belongings during the stay. Elite is not liable for theft, loss, or damage to the Lessee’s personal items, whether from inside the apartment, building premises, or during transfer services.
25. Video Surveillance and Monitoring
For security and operational purposes, common areas in or around Elite properties may be subject to video surveillance. No recording is performed inside leased apartments. By entering the property, Lessee consents to such surveillance in compliance with applicable data protection laws.
26. Force Majeure
In the event of force majeure circumstances such as war, civil unrest, government restrictions, strikes, pandemics, fires, floods, or other unforeseeable circumstances that prevent either party from fulfilling their obligations, both parties shall be released from liability for non-performance for the duration of such force majeure. Any prepaid amounts for services not rendered during such period may be refunded, excluding already consumed services.
27. Health and Sanitation Disclaimer
Elite undertakes to maintain all apartments to a high standard of cleanliness. However, the Lessee acknowledges that shared surfaces, high-traffic areas, and elements beyond the direct control of Elite may pose certain health risks. Lessee assumes all risk associated with communicable diseases, including but not limited to COVID-19.
28. Legal Residency and Visa Responsibility
The Lessee is solely responsible for ensuring compliance with local immigration laws. Elite does not provide legal residency, invitation letters, or visa sponsorship. Booking accommodation does not constitute or substitute for legal residency status in Moldova.
29. Rules and conditions for payment
These rules apply to all tenants and clients benefiting from the rental services offered by ELITE Homes Company SRL.
29.1. Accepted Payment Methods
The client can pay the rent and the related utility services for the rented apartment through one of the following methods:
Cash – at the company’s payment terminal, available at its headquarters or at the location indicated by the company;
Card payment: payments are accepted via major bank cards (Visa, MasterCard, etc.) through a secure payment gateway.
By direct transfer to the bank account indicated by the company or through an authorized electronic platform.
29.2. Payment Deadlines
Rent is paid monthly for long-term rentals (over 30 days), in advance, no later than the 5th of each month.
Rent for short-term rentals (up to 30 days) is paid in advance no later than the first day of rental.
Utility payments are made monthly, after receiving the payment notification/invoice sent by the company, but no later than 5 days from receipt.
For short-term rentals, payment for utility services is not required.
29.3. Payment Details
In the case of payment by bank transfer, the client must indicate their full name and the address of the rented apartment in the transaction description;
Bank details will be communicated by the company upon signing the rental contract or upon request.
All prices are displayed in lei (MDL) or euros (EUR) and include applicable taxes unless otherwise specified. Additional fees may apply for optional services or facilities, which will be disclosed during the booking process.
After successful payment, you will receive a booking confirmation via email.
29.4. Delays and Penalties
For each day of delay in the payment of rent or utility services, a late penalty of 0.1% of the amount due per day may be applied, according to contractual provisions;
In case of prolonged non-payment (over 15 days), the company reserves the right to take measures provided in the contract, including termination or initiation of legal debt recovery procedures.
29.5. Receipt and Confirmation
The client has the right to request a receipt or proof of payment for each transaction made, regardless of the method used;
In the case of electronic payments, the bank confirmation will constitute sufficient proof of payment of the amounts due.
29.6. Refund and Cancellation Policy for Reservations
- Refunds can be initiated in the following cases:
- Voluntary cancellation by the client;
- Cancellation by Elite Homes;
- Refusal of accommodation for justified reasons.
- Depending on the situation, refunds can be requested online in the Elite Homes account or by contacting our Customer Service.
- Voluntary cancellation by the client: If your plans have changed and you no longer wish to rent the apartment, you can easily request the cancellation of the reservation and the refund of the amount paid.
- A full refund of the amount paid will be made in the case of voluntary cancellation at least 20 days before the scheduled rental date. In the case of cancellation and refund request no later than 19 days before the scheduled rental date, a fee of 20% of the reservation value will be retained.
- Amounts paid will not be refunded in the case of cancellation of the reservation on the scheduled rental day. Additionally, in the case of reserving the apartment for multiple days, partial cancellation of the reservation (renting for fewer days than originally booked) is allowed, but the amounts paid will not be refunded.
- In the case of cancellation of the reservation by Elite Homes, the entire amount paid will be refunded.
- In the case of refusal of accommodation on the scheduled date for justified reasons, the entire amount paid will be refunded.
- Justified reasons include:
Maintenance or hygiene issues:- Lack of electricity, gas, water, or heating;
- Defective furniture or appliances (refrigerator, air conditioning).
- Problems with plumbing (clogged drain, defective toilet, lack of hot water).
- Lack of clean linens or towels.
Discrepancies between the offer and reality:
- The apartment does not match the description in the advertisement (number of rooms, amenities).
- The area or location is different from what was promised.
- Lack of promised facilities (WiFi, air conditioning, elevator, parking, etc.).
29.7. Other Provisions
Any misunderstanding regarding payments will be resolved amicably, and in the absence of an agreement, through the competent courts;
Changes to these rules will be announced in advance, in writing, at least 15 calendar days before they come into effect.
30. Intellectual Property and Website Use
All content on Elite’s website (logos, images, text, booking systems) is protected by copyright and may not be copied, reproduced, or used without express written permission. Unauthorized access to our systems, scraping of data, or fraudulent use of our booking engine is strictly prohibited and may result in legal action.
31. Governing Language
These Terms and Conditions are written in English for international use. In the event of translation into other languages, the Romanian version shall prevail in the event of discrepancy or dispute.
